The Government's Legislative Program for 2025/2026

In connection with the opening of the Danish Parliament, the government presented its legislative program for the upcoming parliamentary year. We have compiled a list of the most relevant bills regarding labor and employment law to provide a comprehensive overview of the initiatives expected to impact this area in the coming period.

Consultations on the legislative program from the Ministry of Employment 

Amendment of the Act on Labor Market Supplementary Pension, the Act on Workers' Compensation Insurance, and the Act on the Employees' Compensation Fund. This bill aims to provide a state financial guarantee for ATP, strengthen IT and cybersecurity requirements, and establish a simpler, more transparent rate model for Labor Market Insurance. 

The amendment to the Working Environment Act and the Workers' Compensation Act: The bill's purpose is to adjust the reporting rules for work-related accidents so that the obligation begins on the third day of the injured person's absence instead of the first. Additionally, the proposal clarifies the Danish Safety Technology Authority's supervision of the authorization scheme in the asbestos area. 

Amendment of the Maternity Equalization Act: The bill aims to increase the contribution rate to the maternity equalization scheme for private employers and the self-employed. 

The amendment to the Social Pension Act, the Highest, Medium, Increased Ordinary, and Ordinary Disability Pension Act, and various other acts aims to: The bill aims to tighten the rules for granting and disqualifying disability pensions in cases of serious crimes and strengthen quarantine schemes in the benefit system.

Amendments to the Working Environment Act and the Posting of Employees Act:   The purpose of the bill is to ensure the effective implementation of the Posting of Workers Directive's minimum wage rules through collective and individual agreements. Additionally, the bill strengthens efforts against social dumping and supports a national asbestos strategy. 

The Act on ID Cards for Major Building and Construction Projects: The bill aims to introduce an ID card requirement for construction projects valued at DKK 100 million or more. This initiative is a continuation of the government's "Responsibility for Denmark" platform from December 2022 and its initiative on foreign labor and social dumping from June 2025.

Consultations on the legislative program from other ministries

The Immigration Act is being amended following the legislative program of the Minister for Immigration and Integration. The bill aims to introduce a new business scheme for certified companies that adhere to fair wages and working conditions.  

The Act on Compensation and Reimbursement to Veterans with PTSD follows from the legislative program of the Minister of Defense. The bill's purpose is to introduce a presumption rule in work injury cases so that a connection is generally presumed between events during a veteran's deployment and a PTSD diagnosis, unless there are particularly weighty reasons to indicate otherwise.

The proposed bills are expected to be processed continuously throughout the upcoming parliamentary year. Littler will closely monitor developments and provide ongoing updates as the legislative process progresses.
